What is an ignition interlock?

An ignition interlock is a device that you install into your vehicle which prevents your vehicle from starting unless a clean blow into the device is recorded. An ignition interlock is easy and safe to use. Are you wondering if you need an interlock device?

How do I know if I need an ignition interlock?

Anytime you are convicted of a DUI in the state of Arizona you will be ordered to install an ignition interlock in your vehicle. (A.R.S. 28-3319). According to MADD interlock devices drop repeat offenders by nearly 66% (https://www.madd.org/the-solution/drunk-driving/ignition-interlocks/). The statistics show interlocks save lives. The length of time you will need an interlock device varies.

How long do I need the ignition interlock in my vehicle?

Times vary due to the grade of the DUI, and the total number of DUI’s present on your Motor Vehicle Record. Let’s break it down. You will get an interlock device for 12 months for the following reasons: being convicted of a DUI, being convicted of a DUI with a blood alcohol content of 0.15 or more but less than 0.20, for being convicted of an aggravated DUI, and lastly for any repeat offenses (A.R.S. 28-3319, Section D, Paragraph 1). You will get an interlock device for 18 months if convicted of a DUI with a blood alcohol content of 0.20 or higher (A.R.S. 28-3319, Section D, Paragraph 2). Lastly, you will need an interlock device for 2 years for the following reasons: For being convicted of a DUI with a blood alcohol content of 0.20 or higher, with that conviction being a repeat offense, being convicted of a DUI while having a bad license, for being convicted of a third or subsequent DUI in the period of 84 months, for being convicted of a DUI while under interlock order, and for being convicted of a DUI while driving on the wrong side of a highway (A.R.S. 28-3319, Section D, Paragraph 3).  If you are a first time offender there may be a bright light at the end of the tunnel.

Looking for some good news?

The MVD does offer some clients the opportunity to defer your interlock order time! If you have been ordered to install an interlock device for 12 months you may defer the time from 12 to 6 months. The formula to having the interlock deferred is as follows: First, having completed 16 hour DUI education course, which Arizona DUI Services offers all online. Second, having maintained a functional interlock device and meeting all the state and manufactures requirements. Third, no dirty blows! You cannot attempt to operate your vehicle with a blood alcohol content of 0.08 or higher two or more times during your driving restriction. Fourth, during the DUI incident there must not be any property damage or physical injury to a bystander. Lastly, providing all the needed information to the state that involves your alcohol education, interlock provider, and alcohol screening (A.R.S. 28-3319, Section G). The good news is Intoxalock reports all of your blows and calibrations to the MVD in real time! But what is a clean blow?

How do you use the ignition interlock?

 The following example is based on the Intoxalock device. The first step is to press the button on the device and wait until the screen reads ‘blow’. The next step is to blow into the device mouthpiece, then inhale through the mouthpiece, and lastly exhale into the mouthpiece until the device vibrates. The screen will then show you your blood alcohol content and if the screen then reads ‘start car’, you may put your keys into the ignition and be on your way! It is important to understand that at random times while driving the ignition interlock will start beeping requiring a clean blow. If that happens, find a safe place to pull over in a reasonable amount of time and complete the steps all over again. Where can you get an ignition interlock?

As stated earlier, we have partnered with Intoxalock which has Nationwide coverage. Intoxalock has a facility in every county in Arizona and in most case multiple locations. The answer is in you Extended Motor Vehicle Record (MVR)

When you are trying to figure out which service (or services) you need to reinstate your driver’s license frustration is a common emotion. The Arizona MVD has 1600 employees servicing 3.7 million eligible drivers and 2.4 million registered vehicles to say they have their hands full is an understatement.

Arizona DUI Services has spoken with hundreds of clients looking to get their driver license reinstated but had no idea where they should start. For those struggling to understand which services they need, there is a simple way to figure out. The answer is AZ MVD Now. It’s the Arizona MVD’s user dashboard, and it can tell you what services you need to complete to get your license reinstated. On the website you can purchase your 5-year extended Motor Vehicle Record (MVR). The 5-year extended MVR displays all violations on you driving record and the compliance activities needed to resolve those violations.

Before you can purchase your Extended MVR you need to setup your account. You’re going to have enter some personal information like your driver’s license number, date of birth, and last four digits of your Social Security Number. At face value it may seem hard and confusing, especially for those who aren’t tech savvy. Don’t worry though! With a little electronic know-how (you won’t need much) you can successfully set up an account. We’ll help walk you through the process and even provide pictures. First, go to the AZMVDNow website, https://azmvdnow.gov/home. Once you get on the site, there will be a dashboard with plenty of options. The one you need to be focused on is the red rectangle that says ‘Activate Your Account’, as pictured below.

 After clicking that, you will be offered to sign in or create a new account. Select where it says ‘Sign up now’ as pictured below.

After that you’ll need to provide account info such as email (for a verification code), make a password, and choose a display name. The area to provide said information should look like this. Then press the ‘Create’ button below after filing out your information.

Following that you’ll come to the next step which will require you to enter your phone number for further verification, as pictured below. This may seem like too much security, but remember this account contains private info such as your Social Security Number and driving records! Keep that in mind.

In the future whenever you log into your account, you’ll receive a code to log in via text, preventing unwanted theft of personal data. After completing that step the website will need you to provide identification. You’ll be presented with these choices. Choose the option that best fits your situation. Then you’ll have to provide other info associated with your license or Arizona ID Card, like driver’s license number, birthday, and Social Security Number.

After moving on, if you entered your information correctly, your data kept on file by the MVD should be presented, as pictured below. If the information is yours click ‘confirm’.

Finally, you’ll have to activate enhanced security, which entails facial recognition and the like. You don’t have to enable it, and if you don’t want to just skip that step. This step is just in the event you haven’t provided an email or telephone number to the MVD, so the MVD will ask you to update your information so they can update your record on file, as pictured below.

After correctly verifying your identity you have created your account and you’ll be able to enter your user dashboard and fully browse the website’s features!

Now let’s get back to the 5-year extended MVR. To find your MVR, select on the top bar where it says ‘Other Services’, as shown below. From there select the first option “Driver License Record”. In the drop down select the Extended Certified MVR.

Unfortunately, the Extended MVR is not free but five dollars is a bargain compared to the length of time you will spend trying to get a MVD customer service representative on the phone. WHAT IS THE PURPOSE OF THE MVD REQUIRED ALCOHOL AND DRUG SCREENING?

In a DUI arrest there a so many moving parts and requirements to meet. During the DUI process you may ask yourself why? Why do I need to do so many things? I may not have all the answers but if you are asking what is the purpose of the MVD required Alcohol and Drug Screening; that I can shed some light on.

WHAT IS AN MVD ALCOHOL AND DRUG SCREENING?

For many who have been arrested of a DUI offense the first thing to do after the overnight in jail is to complete the MVD required Alcohol and Drug Screening. The Alcohol and Drug screening is not a urinalysis, it is a one on one assessment. The assessment is designed to evaluate the client’s drug and alcohol history through series of questions.

WHICH ALCOHOL AND DRUG SCREENING?

The most commonly used Alcohol and Drug Screening assessment is the Michigan Alcohol Screening Test or MAST. The MAST was developed in 1971 and is capable of identifying dependent drinkers with a 98% accuracy. The Screener will ask the client a series of questions designed to provoke some introspective regarding social, work and relational issues related to drug and alcohol use. The answers provided help the Screener develop a more in-depth understanding of the clients past.

WHY USE THE MAST FOR THE ALCOHOL AND DRUG SCREENING?

By using the MAST to complete the MVD required Alcohol and Drug Screening the Screener is able to form a comprehensive picture of the client’s history. However, being focused on the client’s history may overlook the early stages of alcohol and drug problems. As a casual observer I think being convicted of a DUI may be an indication of alcohol or drug problem in their early stages, but I am not a Mental Health professional so what do I know.

WHY ARIZONA DUI SERVICES?

Here at Arizona DUI Services our MVD required Alcohol and Drug Screenings are completed 100% online and do not require any intake fees or processing time. The Alcohol and Drug screening is conducted through a video chat platform and take about 30 minutes. 5 Precautions for your Revocation process

The Revocation process should be a smooth process. This is not always the case. Some of our clients get to the end of the process only to find out they are still ineligible for reinstated driving privileges.To make the process go as planned here are 5 precautions for the Revocation process.

  1. Make sure you have all valid scripts and justification for any medication used- including marijuana

Arizona DUI Services is not here to judge you. If a substance was part of the original violation you need to share copies of your prescriptions. The case for your reinstated driving privileges will be bolstered with the additional supporting documentation. Transparency is essential to the revocation process. What If you did not have scripts for the substance in your system at the time of your incident? This is not an automatic denial. However it is important that you share that information with Arizona DUI Services during your evaluation.

2. You may need an interlock device

You’ve waited patiently and have been on your best behavior while your license was revoked. The truth is you still may have some state or court orders requirements to fulfill. It is not uncommon for our clients to complete the Revocation process and still need an ignition interlock. The interlock device is not ideal for clients but authorities believe the additional step of accountability is the best option for everyone involved.

3. Have certificates from prior treatment available 

In most cases clients who have had their licensed revoked have participated in treatment plans or program. Each completed treatment plan is an accomplishment and something to be proud of. Your certificates are evidence of you hard work and dedication directed toward your sobriety. Presenting your certificates to Arizona DUI Services gives us an opportunity to make a more complete evaluation. The certificates are also considered when determining if any additional treatment is needed.

4. Reinstatement will cost money

We have had more than one client call us in a bit of a panic. The client went to the MVD but were still ineligible to reinstate their driving privileges. They are confused because they were assured that we would recommend they get their driver licenses back. After a few call to the MVD with some sensible questions we find the client still had fees to pay before they were able to get their license.

5. If you did not complete any treatment or education for alcohol and substance abuse previously you will

It is not uncommon for us to have clients who were arrested and convicted of a DUI to do nothing to remedy the situation. For whatever reason they did not complete a DUI Alcohol and Drug screening or the 16 Hours of DUI Education. Now they are getting mail correspondence from the MVD notifying them that they are eligible to have their driving privileges reinstated if they complete the Revocation process. The client completes the Revocation process and heads down to the MVD to get a brand-new license and are denied. They are devastated and upset and call us to let us know of their disappointment. A quick call to the MVD and the purpose for the rejection is revealed. They never completed the original Alcohol and Drug Screening or the 16 Hours of DUI Education.

Who gets 36 Hours of DUI Treatment?

Who is most likely to get 36 hours of DUI treatment and what is in 36 hours of treatment? It’s a common question we get almost daily. Unfortunately, to truly identify who is recommended 36 hours of DUI treatment an individual will need to complete the MVD’s DUI Alcohol and Drug Screening. Luckily mental health and medical professionals have created a format to use when identifying Level 1 DUI clients. The matrix is incorporated into the DUI Alcohol and Drug Screening making the outcome much more objective. By setting an objective standard for screeners to follow Level 1 DUI Clients are less likely to be determined by opinion. The term Level 1 DUI offender is used by the AZDHS. The AZDHS categorizes DUI offenders into two categories Level 2 offenders and Level 1 offenders. Level 2 offenders are typically recommended 16 hours of DUI Education. Level 1 offenders are those recommended 36 Hours of Treatment. According to the Arizona Department of Health Services Individuals most likely to be recommended 36 Hours of DUI treatment will fall into one of the following three categories.

DUI Categories

First, an individual arrested or convicted of two or more alcohol or drug related offense. Keep in mind those offenses do not have to be motor vehicle related.

Second, the individual had a BAC of .15 or higher at the time of the arrest and has a one of the following supplemental events, (1) a history of alcohol and drug abuse, (2) admits to having a problem controlling their alcohol and drug use, (3) has been diagnosed with a substance abuse or organic brain disease resulting from substance abuse, (4) has experienced symptoms of withdrawal from alcohol or drug use that included hallucinations; seizures; or delirium or has  been diagnosed with alcohol related medical conditions like liver disease, pancreatitis, or cardiomyopathy by a medical professional.

Finally, the individual meets at least three of the following conditions;

  • Had an alcohol concentration of .08 or higher at the time of the arrest
    • Had been arrested or convicted for an alcohol or drug related arrest
    • Has experienced a decrease in attendance or productivity at work or school due to alcohol or drug use     
    • Has experienced family, peer or social problems associated with alcohol or drug use
    • Responded during the screening in a way that indicated substance abuse
    • Has previously participated in substance abuse education or treatment for problems associated with alcohol or drug use
    • Has experienced black outs as a result of alcohol or drug use
    • Has passed out as a result of alcohol or drug use
    • Has experienced symptoms of withdrawal from alcohol or drug use including shakes, illness relieved by resumed alcohol or drug use; experienced irritability, nausea, or anxiety
    • Exhibits a psychological dependence on drugs or alcohol
    • Has experienced an increase in consumption, a change in tolerance, or a change in the pattern of alcohol or drug use
    • Has experienced personality changes associated with alcohol and drug use

What is in 36 Hours of DUI Treatment?

When you fit into one of the previous categories you are considered a Level 1 DUI Client and will be recommended 36 hours of DUI Treatment. The 36 hours of treatment consists of 16 hours of DUI Education and 20 Hours of DUI treatment. The 20 hours of treatment is generally acquired through group sessions. However, here at Arizona DUI Services we offer all 36 Hours of the DUI treatment online.

16 hours of education

The 16 hours of education is a course we develop based on the Arizona Department of Health Services requirements. Our course starts with a Pre-test. The test is not graded but will give you an idea of your current knowledge and what you will learn. Our DUI education is divided into five modules. Each module has a video we created based on the AZDHS requirement and supplemental videos to drive home the module objectives. At the end of each module you will be tasked with a short quiz. You will answer each question with three to five sentences. Once you have completed the five modules you will take the final exam. To pass the exam you need to score at least 70%. You will have 24-hour access to our education course so you can complete as much as you want when you want to. It is not uncommon for our clients to complete their 16-hour education course in one day.

20 hours of treatment

For the 20 hours of group sessions we have recorded our License Independent Substance Abuse Counselor (LISAC) Robin during a few of her group sessions. There is a total of 10 videotaped sessions you will watch. After some of the sessions there are supplemental videos designed to reinforce the sessions focus. There are also worksheets you will use to follow along with the session and use to track self-improvement. Similarly, to the 16 hours of education you have 24-hour access to the 20 hours of treatment. Again, having 24-hour access to the treatment you can complete as much as you want when you want.

The difference between a Level 1 and Level 2 offender

So, there you have it. Level 1 DUI Offenders will get 36 Hours of Treatment and the 36 Hours of Treatment is actually 20 hours of group sessions and 16 hours of DUI Education. The difference between the Level 1 and Level 2 offenders is the history of alcohol and drug use. When you have a history of drug and alcohol use the probability of being arrested for another DUI increase. The focus of the 36 Hour Treatment is to provide additional information. You should use the additional information to gain a better understanding into how alcohol and drugs impact your behavior. You should also use the information to create healthier habits and coping skills.

The 2020 Holiday Season is the goal not the 2019 Holiday Season.

We are full stride smack dab in the middle of the 2019 Holiday Season and we all know what rides shotgun with the Holiday Season, yep the holiday parties. You have company and corporate Christmas parties, family gatherings, ugly sweater parties or the mildly entertaining dirty Santa exchange and finally the last hoorah for 2019 the New Year’s Eve party all of which typically include old friends, extended family and lots and lots of alcohol. So much alcohol is served during the month between Thanksgiving and New Year that the Distilled Spirits Council of the United States reports earning over $22 million during this time which is a quarter of their yearly profit! With the copious amounts of alcohol flowing the biggest concern of the holiday’s is binge drinking. As a point of reference binge drinking is defined as women drinking 4 drinks and men 5 drinks in a two-hour time frame. For some of you reading this that may be an average Friday or Saturday night but with the jovial atmosphere contained within the holidays making it more socially acceptable to over indulge many problem drinkers and alcoholics push even their normal limits. Not to be out done moderate drinkers have a propensity to increase the amount they typically consume during the holidays as well. However, not all excessive drinking is attributed to the cheerful atmosphere. For some the holiday season is connected to bad memories, isolation, stress, anxiety and financial challenges. Some turn to alcohol to numb the additional pressure created by the holidays and the intensity of the tension can boost the amount of alcohol they normally drink.

Whether the holiday blues or the superfluous cheer is influencing the amount of alcohol what is for certain is there are a lot more people on the roads and in later hours. During the holidays people travel to out of town to see family, drive to get to the mall throughout the extended and later hours of operation, drive to family gatherings and company parties. For whatever reason people are doing a lot more driving during the holidays and are out on the road later in the night and possibly in bad weather making the excessive drinking all the more concerning. 

Regardless of the reason for the over indulgence the fact is it is never a good idea to drink and drive and to avoid being a National Highway Traffic Safety Administration statistic the best thing for you to do is to drink in moderation. However, as I mentioned previously the festive atmosphere has a tendency to make one more drink more acceptable and that one extra drink loosens inhibitions and clouds judgment possible leading to more drinks and ultimately getting behind the wheel when you clearly should not. So, my advice to you is to plan ahead and start the night with the understanding that things may get a bit out of control. Get out in front of your night by downloading the Uber or Lyft apps and if ride sharing isn’t your style the Yellow Cab Company of AZ has an app as well, or identify someone you trust to stay sober and make them your designated driver. To save money on your ride home click the which ride share your prefer Uber or Lyft both offer discounts for new and re-occurring clients. Part of planning ahead is set a benchmark for the number of drinks you plan on having and if you go over by even a half drink engage your back up plan. If you make plans in advance be committed because once the BAC goes up your inhibitions go down and you are more likely to make poor decisions. So, draw the proverbial line in the sand and stick to it. Your life and the lives of others may depend on it.

Buyer Beware! I’m kidding…unless your DUI is with the Glendale City Court then yes beware!

It is true getting a DUI is a scary, embarrassing, confusing and unfortunate event. The courts don’t talk to the MVD and the MVD doesn’t report to the courts. It’s a lot like being an only child of divorced parents. Now typically Arizona DUI Services and the DUI Services and customer service we offer is capable of bridging the gap between the courts and the MVD. When a client completes their mandated alcohol and drug screening, we confirm with the MVD that the DUI Screening has been completed and will send the Screener’s notes to the appropriate court. Similarly, when a client completes the 16 Hour DUI Education, we notify the MVD and send a certificate of completion to the appropriate court. It really is a simple task and something we enjoy doing for our clients. In our experience this process we have of confirming completed Alcohol and Drug Screenings and 16 Hour DUI Education with the MVD and courts works 99% of the time. However, we have come to understand the Glendale Municipal Court has an exclusive agreement with Community Support Services and will not accept our 16 Hour DUI Education and only after some groveling by our client was our Arizona Department of Transportation Motor Vehicle Department approved DUI Screening accepted.
